洋秋菊打官司之十二:未能发出的朱莉致奥巴马的信

17日朱莉因被北京的派出所拘禁,未能见到奥巴马车队,也未能递交写给奥巴马的求助信,于是她只能将信件交由博讯代为传递信息。在信中,朱莉呼吁哈佛校友奥巴马敦促中国领导人落实已经颁布的各项法律,以使更多的中国人享有法律保护和公平正义。

19日,新搬迁的最高人民法院接待室开门接待,上午,朱莉去到这栋新大楼,遇到的却还是旧故事。她被告知没有地方法院的判决书,他们不接待。下午,美联社 驻北京的三名文字及摄影记者跟随朱莉上访,在最高人民检察院接待室,守卫见到朱莉便急忙把门关上,称今日不接待。下午五点前,他们来到位于西城区府右街8 号的中共中央所在地,递交朱莉前些日写给胡锦涛、温家宝和周永康的信,朱莉首次来到神秘的中南海,被警卫勒令站在门口黄线外,有人在门口接下了她的信。

由于传闻安徽五河法院将在下周一就刘士亮案召开合议庭,朱莉准备赶往五河,一来可以陪伴刘士亮的母亲,二来可以再见到刘士亮。

Dear Mr. President,
As an American citizen and a frequent visitor to China, with close connections to both countries, I fully support your efforts to engage China as a strategic partner and ally of the United States.
I hope that you will take this opportunity for direct, face-to-face dialogue with Chinese leadership to strongly encourage that the government make further progress toward universal rights for the Chinese people.
Successful, sustainable development is not merely economic in nature, and in recent years, China has initiated many legal and social reforms. While demonstrating support for these changes, please urge Chinese leadership to make far-reaching, standardized implementation of previous reforms a national priority. Greater rights and legal protections for the Chinese people must be realized by first ensuring that all levels of government, especially villages and counties, comply with laws that in principle have been enacted to provide for increased accountability and justice.
My appeal to you, Mr. President, arises from a very personal incident, in which my Chinese fiancé Liu Shiliang (刘士亮) in June 2009 was arrested on charges of criminal trespassing at a private residence (非法侵入他人住宅罪)—improbably based on a May 2007 incident in which Liu was the victim of a brutal, unprovoked attack from behind, beaten nearly to death while returning to his family home in Anhui province.
Official misconduct, evidenced by Wuhe county authorities’ refusal to administer law according to the principle of “equal justice for all” (一律平等) set forth by the Chinese legal system, directly resulted in Liu’s arrest and imprisonment for the past five months. Despite documented health conditions linked to the 2007 attack, all requests for bail have been denied. Numerous attempts—through county, city, provincial, and national levels of the Public Security apparatus, Procuratorate, and People’s Court, as well as the administrative oversight committee—to legally address the issue and to secure Liu’s release have yielded no resolution of the illegal actions deliberately taken by local authorities.
Therefore, Mr. President, I respectfully request that your Administration express these concerns to Chinese leadership and once again emphasize the importance of full implementation of China’s existing laws in order to strengthen basic legal protections and guarantee justice for all citizens.

尊敬的总统先生,我敦请您关注一个普通个案。我的未婚夫刘士亮在2009年6月被逮捕,并被指控犯有非法侵入他人住宅罪。然而事实真相是,在2007年5月的一次事件中,刘士亮回到他的安徽老家,被人残暴地从身后突然袭击,险些丧生。

安徽五河县政府拒不理会中国法律所规定的“平等公正”的原则,玩忽职守失职渎职,直接导致刘士亮在被捕后监禁长达5个多月。刘士亮07年受伤,导 致其健康存在问题,但多次申请取保候审都被拒绝。我多次到县、市、省和国家一级的公安部门、检察院、人民法院及政法委等机关上访,寻求解决问题的法律途 径,但地方政府并不愿意改变其违法的行为。

尊敬的总统先生,我谨请美国政府向中国领导人表达对上述问题的关切,并重申中国充分执行现行法律的重要性,因为这样做,才会使所有公民享有更多的法律保护和公平正义。
